Fraud is a type of causative action for someone who lies in entering into a contract. The elements are an intentional misrepresentation, or lie, about an existing fact that is material to the deal, that is it’s important to what you’re contracting for. It has to be relied upon by you. That fact has to be relied upon by you when you decide to enter into the contract, and you must have some sort of damage as a result of your reliance, and those are the elements of fraud.
